1. Agreement to Terms

By accessing or using TradeFix AI ("the Service"), operated by Caribbean Cooling BVI ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.

2. Description of Service

TradeFix AI is an AI-powered technical support platform for HVAC, refrigeration, and ice machine professionals. The Service provides AI-assisted fault diagnosis, a searchable fault code database, service report generation, equipment history tracking, and parts/supplier information. The Service is available via web browser at www.tradefixai.net.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep this information up to date.

4. Subscription Plans and Payments

The Service offers Free, Pro, and Enterprise subscription plans. Paid plans are billed monthly. Payments are processed by our third-party payment providers (currently NOWPayments for cryptocurrency and Paddle for card payments). By subscribing to a paid plan, you authorise recurring charges to your chosen payment method. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods.

One-off diagnosis credit packs are non-refundable once purchased. Credits do not expire.

5. Acceptable Use

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) transmit harmful, offensive, or unlawful content; (c) attempt to gain unauthorised access to the Service or its systems; (d) interfere with or disrupt the Service; (e) use the Service for any purpose other than its intended use as a technical support tool for HVAC, refrigeration, and ice machine professionals.

6. AI-Generated Content Disclaimer

IMPORTANT: The AI diagnostic recommendations provided by TradeFix AI are for informational and guidance purposes only.

All AI-generated diagnostic suggestions, fault analyses, and repair recommendations must be verified by a qualified, licensed HVAC/refrigeration technician before any action is taken. TradeFix AI does not replace professional judgement, training, or certification.

Specifically:

• All electrical work must be performed by qualified personnel with appropriate safety precautions. Always de-energise equipment before accessing electrical components.
• Refrigerant handling requires EPA Section 608 certification (US) or equivalent local certification. Never vent refrigerants to the atmosphere.
• The AI may occasionally provide incorrect or incomplete information. Always cross-reference with manufacturer service manuals and your professional training.
• TradeFix AI accepts no liability for any injury, damage, or loss resulting from actions taken based on AI-generated recommendations.

7. Intellectual Property

The Service, including its design, code, AI models, fault code database, and all associated content, is the intellectual property of Caribbean Cooling BVI. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent. Service reports generated by users remain the property of the user.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADEFIX AI AND CARIBBEAN COOLING BVI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Caribbean Cooling BVI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

11. Service Availability

We strive to maintain the Service's availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

12. Modifications to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Antigua and Barbuda. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Antigua and Barbuda.
